Flamio AI Terms of Service

These Terms explain the rules for using Flamio, including accounts, tokens and plans, payments, subscriptions, and acceptable use.

1. Introduction

These Terms of Service (the “Terms”) govern your access to and use of Flamio, operated by Oleksandr Huliuvatyi, an individual entrepreneur (ФОП) registered in Ukraine (“Flamio”, “we”, “us”, or “our”). We operate the website flamio.org, the Flamio web application, the browser extension, and related backend services (collectively, the “Service”).

By creating an account, purchasing a plan, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. The Service

Flamio is an AI-powered UX testing and session-analysis platform. Users create test tasks for websites, record browser sessions, and receive AI-generated UX analysis, a data assistant, visual UX analysis (Flamio Vision), and continuous real-user monitoring (Flamio On-Live).

We may add, change, or remove features over time to improve the Service.

3. Accounts & Eligibility

You must provide accurate account information and keep it up to date. You are responsible for safeguarding your credentials and for all activity under your account.

You must be old enough to form a binding contract in your jurisdiction to use the Service.

4. Tokens, Plans & Usage

The Service uses a token-based usage model. Each billable feature — AI analysis, the data assistant, Flamio Vision, and Flamio On-Live — consumes tokens at a published per-use rate.

Tokens are a prepaid usage credit, have no cash value, are not transferable, and cannot be exchanged for money except where required by law.

  • Plans grant a monthly token allowance billed on a recurring basis.
  • One-time token packs add tokens to your balance as a single purchase.
  • Unused tokens accumulate in your balance and do not expire while your account is active.

5. Payments & Merchant of Record

Payments for the Service are processed by our Merchant of Record, Creem (Armitage Labs OÜ), which acts as the authorized reseller and seller of record for purchases made through the Service.

This means Creem handles the transaction, billing, and applicable taxes (such as VAT or sales tax), and the charge on your statement may appear under Creem.

Prices are shown before purchase. Unless stated otherwise, prices are in US dollars and exclusive of taxes, which are calculated at checkout based on your location.

6. Subscriptions, Renewals & Cancellation

Paid plans are subscriptions that automatically renew at the end of each billing period until cancelled. Each successful renewal grants that period’s token allowance.

You can cancel at any time from your account billing settings. Cancellation stops future renewals; your plan remains active until the end of the current paid period, after which it will not renew.

We may change plan pricing or token allowances with reasonable advance notice; changes apply to the next billing period.

7. Refunds

All payments are non-refundable except where a refund is required by applicable law. You can cancel a subscription at any time to stop future charges. Full details are in our Refund Policy. Refunds, where due, are processed through Creem as Merchant of Record, and your statutory consumer rights are not affected.

8. Acceptable Use

You agree not to:

  • Use the Service unlawfully or to infringe the rights of others.
  • Record sessions or capture data without the rights or consent required by law.
  • Attempt to reverse engineer, disrupt, overload, or gain unauthorized access to the Service.
  • Resell or sublicense the Service without our written permission.
  • Use the Service to process sensitive data (passwords, payment details, government IDs, health data) on pages you record.

9. Intellectual Property

The Service, including its software, design, and content provided by us, is owned by Flamio and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service under these Terms.

You retain ownership of the content and recordings you submit. You grant us the rights necessary to host and process that content to provide the Service, as described in our Privacy Policy.

10. Disclaimers

The Service is provided “as is” and “as available”. AI-generated insights are provided for guidance only and may contain errors; you are responsible for how you use them.

To the maximum extent permitted by law, we disclaim all warranties not expressly stated in these Terms.

11. Limitation of Liability

To the maximum extent permitted by law, Flamio will not be liable for indirect, incidental, special, or consequential damages, or for loss of profits, data, or goodwill.

Our total liability for any claim relating to the Service will not exceed the amount you paid to us for the Service in the three months before the event giving rise to the claim.

12. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you breach these Terms or use the Service in a way that risks harm to others or to the Service.

On termination, your right to use the Service ends. Sections that by their nature should survive (such as payments owed, disclaimers, and limitation of liability) will survive.

13. Governing Law

These Terms are governed by the laws of Ukraine, without regard to conflict-of-law rules, except where mandatory consumer-protection laws of your country of residence apply.

14. Changes to These Terms

We may update these Terms from time to time. When changes are material, we will update the “Last Updated” date and provide notice where required by law. Continued use of the Service after changes take effect constitutes acceptance.
